Chinese Residents Buying Japanese Property: Separate Purchase Eligibility from Cross-Border Funding
Buying in Japan and moving money abroad are separate legal questions
A recurring mistake in cross-border transactions is to assume that because a foreign national can generally acquire real estate in Japan, funds can automatically be transferred from a personal bank account in mainland China for that purchase. These are separate regulatory issues. Buyers should establish where the money is held, who owns the sending account, the stated purpose of the transfer and what documentation the relevant banks require.
Japanese reporting applies to certain acquisitions by non-residents
Japan’s Ministry of Finance states that when a non-resident acquires real estate located in Japan or rights relating to such property, a report under the Foreign Exchange and Foreign Trade Act must generally be submitted to the Minister of Finance through the Bank of Japan within 20 days after acquisition. The current framework also allows a resident agent, including an appropriate representative, to submit the report.
Funding questions to resolve before signing
- Is the purchaser a Japanese resident or non-resident?
- Where are the purchase funds currently held?
- What is the relationship between the remitter and purchaser?
- What source-of-funds evidence will banks require?
- Can cleared funds reach Japan before completion?
- What evidence of overseas address will be required for registration?
Japan’s Ministry of Justice has also clarified the treatment of address evidence for foreign individuals and entities residing abroad that become registered owners in applications filed from April 2024 onward. Available official documents vary by jurisdiction, making early consultation with the judicial scrivener handling registration advisable.
Do not sign first and investigate remittance later
A buyer may possess sufficient assets but still be unable to transfer them by the contractual completion date. Japanese purchase agreements typically contain deposit, completion and default provisions, so available wealth and executable payment capacity are not the same thing.
Property selection should therefore proceed in parallel with verification of the funding route, identity documentation, registration documents and Japanese reporting obligations. Any transfer from mainland China should be checked directly with the relevant financial institutions under the rules applicable at the time of remittance.
